1. Introduction & Acceptance of Terms
Welcome to LUMI, an AI-powered application designed to offer supportive conversations, information, and coping strategies through human-like conversational interactions.
By accessing or using LUMI, you agree to be bound by these Terms and Conditions. If you don't agree with any part of these terms, you must not use LUMI.
2. Nature of Service: LUMI is an AI Sparring Partner
LUMI's primary role is to listen attentively and guide you through self-reflection. LUMI is designed to provide suggestions only when you explicitly request them. It's crucial to understand that:
LUMI is an artificial intelligence tool, not a licensed medical, psychological, or psychiatric professional.
The conversations, information, and strategies LUMI provides are not a substitute for professional diagnosis, treatment, or advice from qualified healthcare providers.
No Warranty of Accuracy: We make no guarantees regarding the completeness, reliability, or accuracy of any information or suggestions LUMI provides. As an AI, LUMI's responses are generated based on its training data and algorithms and may not always be perfectly accurate, current, or appropriate for every individual circumstance.
Crisis Support: While LUMI aims to assist users in overcoming personal crises if desired, LUMI isn't equipped to handle medical emergencies or acute mental health crises. In such situations, you must immediately contact emergency services or a qualified mental health professional.
We strongly advise you to seek professional medical or psychological assistance for any serious health concerns or emergencies.
3. User Responsibilities
By using LUMI, you agree to the following responsibilities. Your access to LUMI may be terminated if you violate these terms.
Age Restriction: LUMI is strictly intended for individuals who are 18 years of age or older. By using LUMI, you confirm that you meet this age requirement.
Accuracy of Information: When you register for an account with LUMI, you agree to provide accurate and truthful registration data. While the accuracy of information shared within your conversations with LUMI is at your discretion, providing honest details about your life circumstances can help LUMI offer more relevant and helpful responses.
Intended Use Only: You commit to using LUMI strictly within the context described in Section 2 ("Nature of Service"). LUMI is designed as an AI sparring partner for self-reflection and supportive conversations. It doesn't replace human contact and should never be considered a substitute for personal interaction or professional human guidance.
No Harmful or Illegal Use: You agree not to use LUMI for any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable purposes. Specifically, you must not:
Discuss or plan any illegal activities.
Attempt to "jailbreak" LUMI or circumvent its safety protocols.
Attempt to reverse-engineer, decompile, or discover the underlying data models, training data, or system prompts of LUMI.
Engage in any activity that could damage, disable, overburden, or impair LUMI's functionality or the servers and networks connected to LUMI.
Privacy of Others: You must not share sensitive personal information about third parties (e.g., full names, specific identifying details) unless you have their explicit consent to do so. Your conversations should respect the privacy of others.
No Emergency Situations: LUMI is not for emergencies. In crisis situations, or if you are in immediate danger or experiencing severe distress, you must seek immediate assistance from emergency services or a qualified mental health professional. LUMI cannot provide crisis intervention or emergency support.
4. Intellectual Property
This section clarifies the ownership of LUMI and the terms regarding the content you generate while using our service.
Ownership of LUMI: All rights, title, and interest in and to the LUMI application, its underlying AI models, software, design, text, graphics, logos, images, as well as the "LUMI" and "Mindmed.ai" trademarks and service marks, are and will remain the exclusive property of Christian Gunzelmann & Dominik Grau GbR (operating as Mindmed.ai). You may not copy, modify, distribute, sell, or lease any part of LUMI or its intellectual property, nor may you reverse engineer or attempt to extract the source code or underlying data structures of LUMI.
User-Generated Content: You retain all ownership rights in the text, data, and any other content you input or create while using LUMI ("User Content").
Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) does not use your User Content to improve or develop LUMI's capabilities unless you explicitly instruct us to do so. This means your conversations with LUMI are private and aren't automatically reviewed or used for training our AI models.
Should you, at any point, wish to provide specific feedback on your conversation with LUMI for the purpose of improving our service, you may do so through designated feedback mechanisms within the application. In such cases, and only with your explicit consent for that specific instance, we may review the provided content solely for the stated improvement purpose.

5. Limitations of Liability
Please read this section carefully, as it limits Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai)'s liability to you.
LUMI is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) doesn't guarantee that LUMI will be uninterrupted, error-free, secure, or available at all times.
Specifically, Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) makes no warranty or guarantee that LUMI will feel human-like, or that your use of LUMI will result in you feeling better or achieving any specific outcomes related to your mental well-being. The effectiveness of LUMI in supporting self-reflection and coping strategies can vary greatly among individuals, and we offer no assurances regarding the results you may experience.
To the fullest extent permitted by applicable law, Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai), its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
Your access to or use of, or inability to access or use, LUMI.
Any conduct or content of any third party on LUMI.
Any content obtained from LUMI.
Unauthorized access, use, or alteration of your transmissions or content.
In no event shall Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai)'s total liability to you for all damages, losses, or causes of action arising out of or relating to these Terms or your use of LUMI exceed the amount of fifty Euros (€50.00), regardless of the form of the action (whether in contract, tort, including negligence, or otherwise).
You acknowledge that Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) isn't responsible for any actions you take based on the information or suggestions LUMI provides, and you use LUMI at your own sole risk.
6. Privacy Policy Reference

7. Termination
This section outlines the conditions under which either you or Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) can end your access to LUMI and manage your account and subscription.
Our Right to Terminate: Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) reserves the right to suspend or terminate your access to LUMI immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. This includes, but isn't limited to, violations of the "User Responsibilities" section.
User Termination of Subscription and Account:
You may cancel your LUMI subscription at any time. Unless you cancel, your subscription will automatically renew at the end of the current billing period.
If you cancel a subscription that covers a longer period (e.g., an annual subscription), you will retain access to all premium features until the end of that paid subscription term.
You can delete your LUMI account directly within the application.
When deleting your account, you will be given the option to also delete your associated data immediately.
Data Retention without Deletion: If you choose not to delete your data upon account deletion, Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) will retain your data for as long as legally required or permitted, primarily to allow you to re-access your data if you create a new account using the same email address.
Subsequent Data Deletion Request: If you deleted your account but chose to retain your data, and later wish to have your data deleted, you must send an email requesting data deletion to support@mindmed.ai.
Effect of Termination: Upon termination of your account or subscription, your right to use LUMI will immediately cease (except for continued access to premium features until the end of a paid subscription term, as noted above). All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Data After Termination: For further details regarding the retention and deletion of your personal data, please refer to our Privacy Policy.
8. Changes to Terms
We may update these Terms and Conditions from time to time. When we do, we'll let you know about any significant changes.
How We'll Notify You: We'll inform you about changes via email and/or through a pop-up notification within the LUMI app or other in-app notifications, depending on the nature and extent of the changes.
When Changes Take Effect: Any changes to these Terms will be effective immediately upon their posting.
Your Acceptance: Your continued use of LUMI after any revisions become effective means you agree to be bound by the updated Terms. If you don't agree to the new terms, you should stop using LUMI.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.
Should a dispute arise out of or relate to these Terms or your use of LUMI, we first ask that you contact us directly at support@mindmed.ai to try and resolve the issue informally.
Should an informal resolution not be possible, you agree that any legal action or proceeding between you and Christian Gunzelmann & Dominik Grau GbR (Mindmed.ai) related to these Terms will be brought exclusively in the competent courts located in Heilbronn, Germany.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
